Terms of Use

1. Parties

This Terms of Use Agreement (the "Agreement") is entered into electronically between Enjoyvent Etkinlik Biletleme ve Teknoloji A.Ş. ("Enjoyvent") and the natural person (the "User") who uses the platform offered at tiyatrobizbize.enjoyvent.com.

The relevant event or activity is run by Bizbize Sahne Sanatları San. Ve Tic. Ltd. Şti. (the "Business"), who is the owner and operator of the event or activity.

2. Definitions

• Site / Platform: The digital sales platform offered at tiyatrobizbize.enjoyvent.com.
• User: Any natural person who visits the Site, registers, or buys a ticket.
• Business: The natural or legal person organising the event or activity.
• Event and Activity: Concerts, theatre performances, festivals, sports matches, exhibitions and similar organisations held at a specific date/time, as well as workshops, courses, experiences, tours, sports sessions, themed programmes and similar recurring or time-bound participation activities.
• Service: The digital platform service provided by Enjoyvent for intermediating the sale of event and activity tickets belonging to the Business.

Enjoyvent acts solely as an intermediary service provider; it is not the owner or operator of the event or activity.

3. Subject of the Agreement

This Agreement governs the terms under which the User purchases tickets to the Business's events and activities through the Platform and uses the services provided.

A ticket purchase constitutes a contract between the User and the Business. Enjoyvent is not a party to that contract and only intermediates it.

4. User Obligations

The User agrees and undertakes the following:

• To use the Platform in accordance with the law and the rules of good faith
• To provide accurate and up-to-date information when registering
• Not to create an account or make payments using someone else's information
• To keep account information confidential
• To be responsible for all transactions made through the account
• Not to resell tickets for commercial purposes
• To comply with the rules of the Business and the venue
• To check age restrictions and participation conditions

5. Enjoyvent's Role

Enjoyvent provides technical and operational intermediation for the sale of tickets to events and activities offered by the Business.

The following are determined by the Business:

• Content
• Date and time
• Venue
• Seating arrangement
• Price
• Age restrictions
• Participation conditions
• Cancellation and refund conditions

All responsibility regarding these matters lies with the Business.

6. Cancellations, Refunds, and Changes

Cancellation and refund conditions are determined by the Business.

In the event of a cancellation or postponement of an event or activity, the process is run by the Business. Enjoyvent technically applies the refund procedure communicated by the Business.

The User is responsible for reviewing the relevant event or activity's refund and change conditions prior to purchase.

7. Account Security

The User is responsible for all transactions carried out through their account.

Enjoyvent is not responsible for damages arising from unauthorised use of the account where there is fault on the part of the User.

8. Intellectual Property Rights

The design, software, and Enjoyvent-branded content on the Platform belong to Enjoyvent.

Event and activity content and visuals may belong to the Business or the relevant rightsholders.

Unauthorised use, copying, or commercial use is prohibited.

9. Personal Data

By using the Platform, the User acknowledges that they have read and understood the Privacy Policy, the Cookie Policy, and the Personal Data Protection Notice (KVKK).

Personal data may be processed:

• By Enjoyvent for the purpose of operating the platform service
• By the Business for organising the event or activity and, where explicit consent has been given, for marketing activities

Enjoyvent and the Business process personal data each as a separate data controller.

10. Limitation of Liability

Enjoyvent is not responsible for direct or indirect damages that may arise from:

• Cancellations or changes caused by the Business
• Disputes regarding event or activity content
• Venue conditions
• Force majeure events
• Technical failures

In any case, Enjoyvent's liability is limited to the amount of the relevant ticket.

11. Changes

Enjoyvent may update the provisions of this Agreement.

The updated text takes effect as soon as it is published on the Platform.

The User's continued use of the Platform means that the updated terms have been accepted.

12. Dispute Resolution

For Users who qualify as consumers, Consumer Arbitration Committees and Consumer Courts are competent.

In other cases, the Istanbul Courts and Enforcement Offices have jurisdiction.

13. Effective Date

This Agreement enters into force when the User gives consent electronically or continues to use the Platform.
